Terms and conditions of participation in the AIRPAQ competition

  1. Subject of the terms and conditions of participation and organizer

(1) These terms and conditions govern participation in the prize draw and any necessary transfer of rights. The description and procedure of each prize draw will be provided within the respective prize draw promotion on the Instagram page of Airpaq UG (limited liability).

(2) The organizer of the competition is Airpaq UG, Im Rabengrund 7 50997 Cologne.

(3) By participating in the respective competition, these terms and conditions of participation are accepted.

(4) This competition is in no way connected with Facebook or Instagram, it is neither sponsored by Facebook nor supported or organized by Instagram.

  1. participation

(1) All persons who have reached the age of 18 are eligible to participate in the competition. Employees of Airpaq UG (limited liability) and affiliated companies, as well as their relatives, are excluded. Participation with false identities or the identities of third parties is not permitted.

(2) Eligible participants may enter the competition by liking the competition post (clicking "Like") and leaving this like in place at least until the winners are selected.

(3) It is also required that the photo is commented on by AIRPAQ and Birkenspanner and that the Instagram pages @Airpaq.de and @Birkenspanner are followed.

(4) Participation is possible until 30 June 2020.

  1. Prizes and prize notification

(1) We will raffle off 1 Airpaq brand backpack and 3 water bottles among all eligible participants. Winners can choose an Airpaq Unicolor in red, blue, black or red.

(2) The winners will be drawn at random from all eligible participants within one week of the closing date. The winners will be notified via Instagram comment or in a separate post and asked to send an email to the specified email address, providing their personal data completely and accurately. This information will be used for sending the prize.

(3) If we do not receive an email from a winner within the specified period, the prize claim expires. In this case, we are entitled to conduct a substitute draw.

(3) Only one prize is possible per participant.

(4) The prize is neither transferable nor can it be exchanged or paid out in cash.

(5) If circumstances arise for which we are not responsible, the respective winner accepts a suitable substitute prize. Such circumstances beyond our control include, in particular, those attributable to the prize sponsors.

(6) The prizes will be sent to the winner by post to the address provided. The risk passes to the winner upon handover of the prize to a transport company. We are not responsible for any damage incurred during delivery.

  1. Granting of rights of use

(1) By accepting the prize, the winner agrees that we may use his name for advertising purposes.

  1. Liability and indemnification

(1) If the participant uploads photos, the participant guarantees that he will not submit any content whose provision, publication or use violates applicable law or the rights of third parties.

(2) The participant shall indemnify us against any and all third-party claims arising from the unlawfulness of photographs used by the participant. This indemnification obligation also includes the obligation to fully indemnify the organizer against all legal defense costs (e.g., court and attorney fees).

(3) By participating in the competition, the participant releases Instagram from any liability.

  1. exclusion

(1) A violation of these terms and conditions of participation entitles us to exclude the respective participant from participation. This applies in particular if the participant provides false information or if photos or other content used (e.g., comments) violate applicable law or the rights of third parties. The same applies to comments that can be considered to glorify violence, be offensive, harassing, or degrading, or that otherwise violate common decency.

(2) If the excluded participant is an already selected winner, the prize may be subsequently revoked.

  1. Premature termination and changes

We reserve the right to terminate the competition prematurely, in whole or in part, or to modify its course at any time, even without observing deadlines, if it is not possible to guarantee the proper conduct of the competition for technical reasons (e.g., computer virus, manipulation of or errors in software/hardware) or legal reasons (e.g., prohibition by Instagram).

  1. Data protection

We are responsible for the collection, processing, and use of participants' personal data, insofar as we process it ourselves. We will use the participant's personal information and other personal data only within the framework of the applicable data protection laws. We will only store, process, and use the information to the extent necessary for conducting the prize draw or if the participant has given their consent. This also includes use for exercising the granted rights of use. The data will be used exclusively for conducting the prize draw and will be deleted afterward.

Participants can request information about their stored personal data at any time. Our privacy policy, which can be found at https://deutsch.airpaq.de/pages/privacy-policy, also applies.

  1. Final Provisions

(1) Should the terms and conditions of participation contain any invalid provisions, the validity of the remaining provisions shall remain unaffected.

(2) German law applies. Legal recourse to review the draw is excluded.
